PROSPERITY — Former Prosperity Police Officer James M. Smithson, 44, awaited a bond hearing at noon on Friday at the Richland County Courthouse in Columbia.
Smithson was officially indicted by the state grand jury for a total of three counts, according to Mark Powell, communications director for the S.C. Attorney General’s office.
Powell said that the first count is for office misconduct and the other two counts are both for distribution of marijuana.
Smithson was arrested Sept. 27 on drug charges and was an officer with the Prosperity Police Department. He was place on administrative leave, according to Prosperity Police Administrator Benji Sease in a previous interview.
He is now no longer employed with the police department as his last day was Oct. 16.
The misconduct did occur because of the distribution, Powell previously stated.
