Prosperity to settle with fired police chief

In December 2007, terminated Prosperity Police Chief Scott Wilson said “it is not over” in reference to his firing. But with a vote to spend up to $15,250 in town funds last night, the case may finally be settled.

In a special called meeting, Prosperity Town Council passed first reading of an ordinance authorizing the town’s administrator to withdraw up to that amount to settle the case of Wilson vs. The Town of Prosperity. The second and final vote on this is slated for the council’s next regular meeting day, Nov. 17.

Wilson brought a wrongful termination suit against the town after being fired in October 2007.

Wilson was fired for insubordination after asking the state’s attorney general for an opinion on whether performing the duties of police chief and that of a clerk of court for the town would be a conflict of interest.

There was some dispute between Wilson and the mayor and town administrator about what particular duties the police chief had been assigned. At issue also was whether Wilson had been insubordinate by not following town policy how he pursued his grievance about the supposed conflict in duties. Wilson insisted he had presented his grievance to both the town administrator and Mayor Larry Spotts.

Wilson appealed his firing to Prosperity’s Town Council in November 2007. The council voted to uphold the termination recommended by Town Administrator Karen Livingston in December 2007.

Wilson sought legal counsel after his firing was upheld by council.
