Two of the changes required to create the new Campus Transition Overlay Zoning District were delayed at City Council’s July meeting after a public hearing was held on the changes. Council sent the recommended ordinance changes back to the city’s Planning Commission for adjustments.
One vote is set to amend the text of the city’s zoning ordinance, the other is to make changes to the city’s zoning map.
Several city residents spoke at the public hearing last month, in the main expressing concerns about permanently allowing future development uses in the new district to be determined by college administration without city oversight.
Potential storm water runoff from the addition of more paved areas was also a concern.
The three additional permitted uses in the proposed College Transition Overlay (CTO) District include: parking lots, classroom buildings and office space. The classroom and office uses stipulate the buildings could only be scheduled for that purpose during daytime hours.
City officials addressed the stormwater concerns by repeatedly citing the recent study done of Scotts Creek and pointing out that new regulations are in place regarding the building of parking lots within the city. The regulations require retention ponds and other precautions when each parking lot is built, in theory eliminating future runoff problems from paving projects.
Councilman David DuBose said he was uneasy with the “buffer” zones set up by the ordinance changes between CTO district areas and private residential property. DuBose and any other interested councilman were to meet with the Planning Commission as it reworked the zoning proposal.
The two votes are set for first readings tomorrow at 7 p.m. at City Hall.

• Second reading to rename the C-1 zoning district establishing the “Campus Main” zoning district and providing for other permitted and special exception uses.
• Second reading and adoption of an ordinance authorizing a lease agreement with The Newberry Dove Club.
• First reading of an ordinance amending Article V. Solid Waste Collection and Disposal of the Code of Ordinances of The City of Newberry.
• First reading of an ordinance amending Chapter 11. Nuisances, Offenses and Miscellaneous Provisions, so as to establish Section 11-33. Residential Vehicles and Lawn Equipment Sales.
• Discussion of a community achievement sign policy.
• Executive session with discussion of appointment of capital project sales tax commission representatives; negotiation of contractual agreements relating to the Oakland Mill project; discussion of a contractual agreement for an economic development project; and discussion of legal matters relating to a business license application and road ownership.
