The suit is over NEC lines that have been annexed into the town limits through the years, with those residents being then required to buy electricity from the Town of Prosperity.
Since the lawsuit was filed, representatives from the town and co-op have been negotiating and trying to reach a settlement.
Last night, Prosperity Town Council agreed to support a working agreement.
The details of the working agreement are being withheld from the public until the deal is finalized and documents have been signed, according to Mayor Larry Spotts.
“It should benefit both us and the co-op,” Spotts said of the deal.
During the negotiations, representatives discovered that an ordinance to incorporate Prosperity-Rikard Elementary School into the town limits was never completed.
Spotts said the council voted to annex the property some 15 years ago, but did not vote on an ordinance that would annex the land.
Last night, council gave the first of two readings on the ordinance to correct that oversight and annex the school’s lands.
Second reading on the ordinance will be held at a special town meeting next Wednesday at 6:30 p.m. at the Prosperity Town Center.
